7. Contingent Liabilities
7.1 Lawsuits
As at 30 September 2023, PWA has 10 lawsuits which are a defendant and probably accept
obligation amount 337.54 million baht as follows:
7.1.1 The litigant filed a lawsuit with the Central Administrative Court, Black Case No. 1678/2019,
requesting the Court to determine or order PWA to pay for damages from infringement with the
monetary claim amounting to 0.60 million baht with 7.5 percent interest per year, from the date of
infringement to the date of filing the lawsuit and following the date of filing the lawsuit until the payment
is fully made.
The case is now pending under consideration of the Central Administrative Court.
7.1.2 The litigant filed a lawsuit with Khon Kaen Administrative Court, Black Case No. 19/2022,
claiming damages from PWA in violation against the litigant, causing damage to the litigant’s property,
with the monetary claim amounting to 0.74 million baht with default payment interest at 7.5 percent
per year of the filing capital from the date following the filing date until the payment is fully made.
Additionally, PWA was asked to pay court fees and lawyer fees on behalf of the litigant.
The case is now pending under consideration of Khon Kaen Administrative Court.
7.1.3 The litigant filed a lawsuit with the Central Administrative Court, Black Case No. 387/2021,
requesting PWA to pay for damages from the termination of four sale and purchase water contracts in
the area of PWA Phuket Branch. The litigant proceeded to claim the amount of 322.93 million baht and
damages of 0.12 million baht per day from the date specified in the order to notify the termination of
water supply to PWA system (3 February 2021) to the date when PWA reaccepted the water supply
to PWA system. PWA, the defendant, requested the Court to consider whether the litigant asking concession
according to the Announcement of the Revolutionary Council No. 58 dated 26 January 1972.
The case is now pending under consideration of the Central Administrative Court.
7.1.4 The litigant filed a lawsuit with the Central Administrative Court, Black Case No. 2500/2021,
requesting the Court to determine PWA to pay compensation for utilization cost from infringement
with the monetary claim amounting to 1.11 million baht, and PWA was asked to demolish and remove
waterworks pipes from the litigant’s land within 60 days.
The case is now pending under consideration of the Central Administrative Court.
7.1.5 The litigant filed a lawsuit with Phetchaburi Provincial Court, Black Case No. Mor46/2022,
requesting PWA to demolish buildings and remove waterworks pipes from the litigant’s land and
prohibiting PWA to get involved in such land. In case PWA fails to comply with the aforementioned,
the litigant shall proceed the case by himself/herself and PWA shall be responsible for all expenses.
Moreover, PWA was asked pay the damages of 0.01 million baht per month to the litigant from the date of
filing the lawsuit until PWA finishing demolition and removal of items from the land. Additionally,
PWA was requested to pay court fees and lawyer fees on behalf of the litigant.
The case is now pending under consideration of Phetchaburi Provincial Court.
7.1.6 The litigant filed a lawsuit with Phitsanulok Administrative Court, Black Case No. 60/2020,
requesting the Court to determine PWA to demolish waterworks pipes from the litigant’s land and pay
compensation, severance pay, including compensation for building new building. The monetary claim
amounted to 2.54 million baht with default interest rate of 7.5 percent per year of the capital from the date
of filing the lawsuit until the payment is fully made.
The case is now pending under consideration of Phitsanulok Administrative Court.
